The discussion of how to use artificial intelligence (AI) has intensified as technology and AI have become more integrated into our daily lives. But AI is not a new or novel idea.

Artificial intelligence has been a reality since the 1950s, and health care professionals have been using it since the early 1970s. Clinical and biomedical researchers were the first to use artificial intelligence applications. Since then, AI has expanded to every sector of health care – administrative, surgical, preventative care – improving patient outcomes, reducing costs, and increasing the overall efficiency of the health care system.

With increased discussions around innovation, privacy, and regulations, AI has become a worldwide hot topic across all industries, including health care.

Regulating AI in Health Care & Life Sciences

HIA identified a gap in the discussion about using artificial intelligence in health care. Most conversations about AI would only briefly touch on health care and how it could be used, failing to delve into privacy and HIPAA issues, how industry professionals were already using AI, and legislative and regulatory matters related to its use.

Identifying this need, HIA worked with a broad group of stakeholders to create principles intended to guide Congress and the Administration. The principles focus exclusively on AI in health care, allowing for innovation and protection of patients and their information.

HIA’s principles for AI in health care:

Risk-Based Approach: Regulation of AI in health care should be proportionate to risk

Transparency: Patients, users, and regulators of AI should have access to information about how the technology is being used, but not to proprietary information

Privacy: Any use of health information by AI should be compliant with current laws and regulations, including HIPAA

Equity: AI tools should mitigate bias and be available for all users, not just those who can afford it
